Result- After filing a Motion to Suppress the stop on the grounds that the officer was not currently certified to operate the radar device, the State dismissed the DWI and speeding violations. April 2015

DWI for drugs/marijuana and Xanax and cocaine. Facing up to a year loss of license. Defendant did not know he could refuse to give blood and urine, so like many others, he complied with the police request and gavve both.

Both the blood and urine result were suppressed because the defendant did not legally consent, therefore the State had to dismiss the DWI and the defendant plead guilty to careless driving with no license suspension.

Defendant charged with DWI and drugs. Defendant was Spanish and did not speak English. Defendant was facing possible deportation, 7 months to a year loss of driving privileges. Defendant provided a urine and blood sample to the State.

I proved the that the defendant never consented to give blood. All labs results were thrown out. The DWI was dismissed, the defendant plead guilty to reckless driving with no license suspension.
